Export Compliance — All pharmaceutical exports are conducted in compliance with Indian export regulations, CDSCO requirements, and the applicable import regulations of the destination country. The buyer is responsible for ensuring that imported products meet local regulatory requirements in their country, including Ghana FDA approval where applicable.
Minimum Order Quantities — MOQs vary by product and manufacturer. Final MOQ details are confirmed at the quotation stage and documented in the proforma invoice.
Quotations and Orders
All quotations provided by Divy Tradelink are subject to product availability, manufacturer pricing, and current freight rates at the time of the quotation. A quotation is valid for the period specified within the proforma invoice and does not constitute a binding contract until a formal purchase order has been received and confirmed in writing by Divy Tradelink.
Orders are confirmed upon receipt of the agreed advance payment or Letter of Credit as specified in the proforma invoice. Divy Tradelink reserves the right to decline any order at its discretion, including where export restrictions apply or where we are unable to verify the legitimacy of the buyer’s business.
Payment Terms
Payment terms are agreed on a per-order basis and documented in the proforma invoice. Standard payment options include advance bank transfer (T/T) and Letter of Credit (L/C) for qualifying orders. All payments must be made in the currency specified on the proforma invoice.
Divy Tradelink is not responsible for bank charges, currency conversion costs, or delays arising from the buyer’s banking institution. Orders will not be processed or dispatched until payment has been confirmed and cleared.
Delivery and Logistics
Delivery Timelines — Estimated delivery timelines are provided in good faith and are subject to manufacturer lead times, customs clearance procedures, freight carrier schedules, and conditions beyond our control including force majeure events. We will keep you updated at all stages of the shipment process.
Risk and Title — Risk in the goods transfers to the buyer upon handover to the freight carrier at the point of export from India, unless otherwise agreed in writing. Title to the goods transfers upon receipt of full payment.
Customs Clearance — The buyer is responsible for all customs duties, import taxes, and clearance procedures in the destination country. Divy Tradelink provides all required export documentation to facilitate customs clearance but is not responsible for delays or costs arising from the buyer’s country’s import procedures.
Damaged or Lost Shipments — In the event of damage or loss during transit, the buyer must notify Divy Tradelink within 48 hours of delivery or discovery. Claims must be supported by photographic evidence and the relevant courier or freight documentation. Divy Tradelink will assist in liaising with freight insurance providers where applicable.
Documentation
Divy Tradelink provides a standard export documentation package with every confirmed shipment, including Commercial Invoice, Packing List, Bill of Lading or Airway Bill, Certificate of Origin, WHO-GMP Certificate, Certificate of Analysis (COA), and Free Sale Certificate (FSC). Additional documents required by the buyer’s regulatory authority will be accommodated where reasonably possible and notified in advance.
The buyer is responsible for providing accurate and complete information to enable correct documentation. Divy Tradelink is not liable for documentation errors arising from incorrect information provided by the buyer.
Returns and Disputes
Due to the regulated nature of pharmaceutical products and international export transactions, returns are not accepted once a shipment has been dispatched unless the product is confirmed to be defective, incorrectly supplied, or damaged in transit.
In the event of a dispute, both parties agree to first attempt resolution through direct communication with our team at info@divytradelink.com. If a resolution cannot be reached within 30 days, the matter shall be referred to arbitration in accordance with Indian arbitration law. These Terms and Conditions are governed by the laws of India.
Intellectual Property
All content on divytradelink.com — including text, product descriptions, blog articles, logos, images, and design elements — is the intellectual property of Divy Tradelink or its content providers. You may not reproduce, distribute, or republish any content from this website without prior written permission from Divy Tradelink.
Limitation of Liability
